1. Acceptance of Terms

By accessing or using Process Catalog ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Process Catalog is a SaaS platform that provides process discovery, analysis, and mining capabilities for software development teams. The Service includes:

• Source code analysis and process discovery
• BPMN and process diagram generation
• Process mining and analytics
• GitHub integration
• Team collaboration features
• API access

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to use the Service. By registering, you represent that you meet this requirement.

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access
• You are responsible for all activities under your account
• One person or legal entity per account

3.3 Account Information

You must provide accurate, current, and complete information during registration and keep it updated.

4. Acceptable Use

4.1 You May:

• Use the Service for lawful business purposes
• Analyze your own source code repositories
• Analyze repositories you have permission to access
• Export your data at any time

4.2 You May NOT:

• Use the Service for any illegal purpose
• Violate any intellectual property rights
• Analyze repositories without proper authorization
• Attempt to reverse engineer or hack the Service
• Use the Service to send spam or malicious content
• Overload or disrupt the Service infrastructure
• Share your account with unauthorized users
• Scrape or crawl the Service without permission
• Resell or redistribute the Service

5. Subscription and Billing

5.1 Pricing Plans

We offer various pricing tiers (Free, Starter, Professional, Enterprise). Current pricing is available at /pricing.

5.2 Billing

• Paid plans are billed monthly or annually in advance
• Prices are in USD unless otherwise stated
• Payment is processed securely via Stripe
• You authorize us to charge your payment method automatically

5.3 Upgrades and Downgrades

• You may upgrade or downgrade your plan at any time
• Upgrades take effect immediately with prorated charges
• Downgrades take effect at the end of the current billing period
• Refunds are not provided for mid-cycle downgrades

5.4 Usage Limits

Each plan has usage limits (projects, runs, storage). Exceeding limits may result in:

• Service suspension until limits are restored
• Automatic upgrade prompts
• Overage charges (for Enterprise plans with custom agreements)

5.5 Refunds

• 14-day money-back guarantee for first-time subscribers
• No refunds for renewals or subsequent billing periods
• Contact support@processcatalog.io for refund requests

6. Free Trial

• New users may be eligible for a 14-day free trial
• Credit card required but not charged during trial
• Cancel anytime during trial to avoid charges
• One trial per user/organization

7. Data and Privacy

7.1 Your Data

• You retain all rights to your source code and data
• We only store process metadata and generated artifacts
• You can delete your data at any time
• Data export available in standard formats (JSON, BPMN, etc.)

7.2 Privacy

Our collection and use of personal data is governed by our Privacy Policy.

7.3 GitHub Access

• You grant us permission to access repositories via your GitHub token
• We access only the repositories you configure
• You can revoke access at any time
• We do not clone or store your complete source code

8. Intellectual Property

8.1 Our IP

The Service, including all software, designs, trademarks, and content, is owned by us and protected by intellectual property laws.

8.2 Your IP

You retain all rights to your source code and data. By using the Service, you grant us a limited license to process your data solely to provide the Service.

8.3 Generated Artifacts

BPMN diagrams, process catalogs, and analytics generated from your code belong to you. You may use, modify, and distribute them freely.

9. Service Availability

9.1 Uptime

• We strive for 99.9% uptime but do not guarantee it (except Enterprise SLAs)
• Scheduled maintenance will be announced in advance
• Emergency maintenance may occur without notice

9.2 No Warranty

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

11.1 By You

• You may cancel your subscription at any time
• Access continues until the end of the current billing period
• You may request account deletion via Settings

11.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay fees
• Engage in fraudulent activity
• Pose a security risk

11.3 Effect of Termination

• Access to the Service will be revoked
• Your data will be deleted within 90 days (backup retention)
• You may export your data before termination

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or prominent notice. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles. Any disputes shall be resolved in the courts of [Your Jurisdiction].
